Western Australian Consolidated Acts (1) Any adult who
knows that —
(a) an
unclassified film that would, if classified, be classified RC, X 18+ or
R 18+; or
(b) a
film classified RC, X 18+ or R 18+,
is to be exhibited in
a public place, must not permit a minor to attend the exhibition of the film.
Penalty: $5 000.
(2) A minor who is
15 years of age or older must not attend the exhibition in a public place
of a film classified RC, X 18+ or R 18+, knowing that the film is so
classified.
Penalty: $200.
(3) A person must not
exhibit in a public place a film classified R 18+ if a minor is present
during any part of the exhibition.
Penalty: $5 000.
(4) It is a defence to
a charge of an offence against subsection (3) for the person charged to
prove that —
(a) the
minor produced to the person charged or that person’s employee or agent
acceptable proof of age before the minor was admitted to the public place; or
(b) the
person charged or that person’s employee or agent believed on reasonable
grounds that the minor was an adult.
