Western Australian Consolidated Acts (1) A person must not
exhibit so that it can be seen from a public place that is outside the place
where it is exhibited —
(a) an
unclassified film that would, if classified, be classified R 18+ or
MA 15+; or
(b) a
film classified R 18+ or MA 15+.
Penalty: $2 000.
(2) The Minister may,
by notice published in the Government Gazette and served on the exhibitor of
the film, exempt an exhibitor of films from subsection (1) on such
conditions as are specified in the notice.
(3) A person must not
exhibit in a place that is not a public place, in the presence of a
minor —
(a) an
unclassified film that would, if classified, be classified R 18+; or
(b) a
film classified R 18+,
unless the person is a
parent or guardian of the minor.
Penalty: $2 000.
(4) It is a defence to
a charge of an offence against subsection (3) for the person charged to
prove that the person believed on reasonable grounds that the minor was an
adult.
