Western Australian Consolidated Acts (1) If —
(a) a
publication, film or computer game has been seized under this Act and is in
the possession or control of the prosecution; and
(b) the
owner of the publication, film or computer game, or a person charged with an
offence relating to the publication, film or computer game, wishes to submit
an application for classification of the publication, film or computer game,
the prosecution must,
at the request of the person, forward the person’s application with the
publication, film or computer game, or a copy of the publication, film or
computer game to the Board on behalf of the person.
(2) Despite
subsection (1), the prosecution may refuse to forward the application
until all fees payable to the Board for the classification and the postage
costs associated with the application are given to the prosecution.
