Western Australian Consolidated Acts (1) Notwithstanding
anything to the contrary contained in the Land Drainage Act 1925 , or in
any other Act, but subject to subsection (2), the Corporation may divert,
intercept, and store all water coming from the watercourses and other sources
within the boundaries of any catchment area or water reserve, and may take any
water found on or under the land situated within any such catchment area or
water reserve.
(2) The Corporation
shall not exercise the powers conferred by subsection (1) in relation to
water to which section 5C of the Rights in Water and Irrigation
Act 1914 applies, except under a licence or right granted or conferred
under Part III of that Act.
