CONSERVATION AND LAND MANAGEMENT ACT 1984 - SECT 133
133 . Delegation by Minister and CEO
(1) The Minister may,
either generally or as otherwise provided by the instrument of delegation, by
writing signed by him, delegate to the CEO or a person employed in the
Department any of his functions under this Act or the
Biodiversity Conservation Act 2016 , other than —
(a) this
power of delegation; or
(b) the
power to make any instrument of legislative effect; or
(c) a
function that the Minister has under the Biodiversity Conservation Act 2016
section 260 or 261.
(2) The CEO may,
either generally or as otherwise provided by the instrument of delegation, by
writing signed by him, delegate to a person employed in the Department any of
his functions under this Act or the Biodiversity Conservation Act 2016 , other
than —
(a) this
power of delegation; or
(b) a
function delegated to the CEO under subsection (1); or
(c) a
function that the CEO has under the Biodiversity Conservation Act 2016
section 122, 125 or 126.
(3) Without limiting
the things that may be delegated under subsection (2), they may include things
that are to be done in the course of governing the affairs of the Executive
Body under section 36(4).
