247 . Effect of provision requiring document to be given to particular person or child
(1) A person is not
required to comply with a provision of this Act that requires the person to
give a document to another person, or to ensure that a document is given to
another person, if, after reasonable inquiries, the other person cannot be
found.
(2) Subsection (1)
does not apply if the document is to be given to a party to protection
proceedings.
Note for this subsection:
Section 154 gives the
Children’s Court power to dispense with service in protection
proceedings.
(3) Without limiting
subsection (1), a person is not required to comply with a provision of this
Act that requires the person to give a document to a child, or to ensure that
a document is given to a child, if the person considers that the child does
not have sufficient maturity to understand the document or the matter to which
the document relates.
