CONSTITUTION ACT 1889 - SECT 74
74 . Appointment to offices under the Government of the Colony to be vested in the Governor
The appointment to all
public offices under the Government of the Colony hereafter to become vacant
or to be created, whether such offices be salaried or not, shall be vested in
the Governor in Council, with the exception of the appointments of officers
liable to retire from office on political grounds, which appointments shall be
vested in the Governor alone. Provided always, that this enactment shall not
extend to minor appointments which by Act of the Legislature or by order of
the Governor in Council may be vested in heads of departments or other
officers or persons within the Colony.
