BELL GROUP COMPANIES (FINALISATION OF MATTERS AND DISTRIBUTION OF PROCEEDS) ACT 2015 - SECT 60
60 . Confidentiality of information
(1) In this section
—
confidential information means information that
has not been made public.
(2) A person must not
misuse confidential information obtained by reason of any function that person
has, or at any time had, in the administration of this Act or in the course of
the provision of services for the purposes of this Act.
Penalty: a fine of $12 000 or 12 months
imprisonment, or both.
(3) A person misuses
confidential information if it is, directly or indirectly, recorded, used or
disclosed, other than —
(a) in
the course of duty; or
(b)
under this Act or another law; or
(c)
under the order of a court, tribunal or person acting judicially; or
(d) for
the purposes of the investigation of any suspected offence or the conduct of
proceedings against any person for an offence; or
(e) with
the consent of the person or persons to whom the information relates; or
(f) in
prescribed circumstances.
(4) If confidential
information is lawfully disclosed, this section does not prevent the further
disclosure of the information, or the recording or use of the information, for
the purpose for which the disclosure was made.
