Western Australian Consolidated Acts (1) No liability
attaches to the Chairperson or any other member of the Board or a tribunal,
the Registrar, or any other person for any act or omission by or on the part
of that person, or by the Board or on the part of the Board, that occurred in
good faith and in the performance or discharge, or purported performance or
discharge, of the functions of that person or the Board under this Act.
(2) A party to a
dispute or a witness appearing before the Board or a tribunal has the same
protection, and is subject to the same liabilities, as a witness in any case
tried in the Supreme Court.
(3) No action or
proceeding, civil or criminal, lies against the Crown in right of the State,
the Minister, the Chairperson or a member presiding at a tribunal or the
Registrar in respect of the publication of a transcript of proceedings of the
Board or a tribunal or of a report of a determination made, or the reasons for
a determination given, by the Board or a tribunal.
