Western Australian Consolidated Acts (1) In this
section —
former office means the office of Auditor General
under the Financial Administration and Audit Act 1985 .
(2) Despite
Schedule 1 clause 1, if a person held the former office immediately
before the commencement of this Act (other than in an acting capacity), that
person is entitled to hold office as Auditor General in accordance with
Schedule 1 until the person reaches 65 years of age.
(3)
Subsection (2) does not apply if the person resigned from the former
office with effect immediately before the commencement of this Act.
(4) If a person
holding office under subsection (2) is able and willing to continue as
Auditor General, the Governor may authorise the person to continue to hold
office as Auditor General in accordance with this Part after reaching
65 years of age for a period not exceeding 12 months determined by
the Governor.
(5) The Financial
Administration and Audit Act 1985 section 73 continues to apply to
a person holding office under subsection (2) or (4).
