Western Australian Consolidated Acts (1) On and after the
proclaimed date the body corporate hitherto constituted under this Act and
having the name of “The Western Australian Art Gallery Board” is
preserved and continues in existence as a body corporate under and subject to
the provisions of this Act having the name of “The Board of the Art
Gallery of Western Australia”, but so that the corporate identity of the
body corporate and its rights and obligations are not affected.
(2) The
Board —
(a) is a
body corporate with perpetual succession and a common seal; and
(b) is,
subject to the provisions of section 20(2) and (3), capable in its
corporate name of acquiring, holding, leasing, exchanging, mortgaging and
disposing of real and personal property and of suing and being sued.
(3) All courts, judges
and persons acting judicially shall take judicial notice of the common seal of
the Board affixed to a document and shall presume that it was duly affixed.
