Western Australian Consolidated Acts (1) A local government
that fails to comply with a direction contained in a notice served on it under
section 43 commits an offence.
Penalty: For a first offence, $300; for any
subsequent offence, $1 500.
(2) For the purposes
of this section and section 45 a local government on which a notice has
been served under section 43 shall not be regarded as having failed to
comply with the direction contained in the notice by reason only that it has
not controlled declared plants or declared animals in the manner specified in
the notice so long as it has controlled the plants or animals in some other
manner.
