Western Australian Consolidated Acts (1) Any wages due to
or property known to belong to a person of Aboriginal descent who is deceased
or who cannot be found, and any estate or other moneys to which such a person
was entitled howsoever, shall forthwith, be paid or delivered by the employer,
trustee, debtor or other person liable to pay or deliver the same to the
executor of the will of the deceased person, if known to him, or otherwise to
the Public Trustee, and failure to do so is an offence against this Act.
(2) The Public Trustee
may recover any such wages or property by action in his name in any court of
competent jurisdiction.
(3) In the case of a
person of Aboriginal descent who cannot be found, and in the event of no claim
being made within a period of 3 years, the Public Trustee shall hand over
any such money or property to the Authority to be applied for the purposes of
this Act and shall thereupon be discharged.
