Western Australian Consolidated Acts (1) The Minister is to
ensure that the Commission is provided with the facilities and services that
are reasonably necessary to enable it to perform its functions.
(2)
Without limiting subsection (1) the Minister may arrange for the
Commission to make use, either full-time or part-time, of —
(a) the
services of any person employed under Part 3 or section 100 of the Public
Sector Management Act 1994 ; or
(b) any
facilities or services of a department of the Public Service.
(3) The arrangement is
to be made by the Minister with —
(a) the
department of the Public Service that principally assists the Minister in the
administration of this Act; or
(b) in
the case of any other constituent of the Public Service, the relevant
Minister, and if necessary the relevant employing authority (within the
meaning of the Public Sector Management Act 1994 ),
on terms and
conditions that are agreed between them.
(4) Without limiting
subsection (1) the Minister may arrange for the chief executive officer of the
department that principally assists the Minister in the administration of this
Act to engage or employ, under section 100 of the Public Sector Management Act
1994 , consultants or professional, technical or other assistance to enable
the Commission to carry out its functions.
