TOWN PLANNING AND
DEVELOPMENT AMENDMENT
BILL 1997
A BILL FOR
AN ACT to require reasons for the Minister's
determinations on appeal under the Town Planning
and Development Act 1997.
The Parliament of Western Australia enacts as follows:
Short title
1. This Act may be cited as the Town Planning and
Development Amendment Act 1997.

Commencement
2. This Act comes into operation on the day on which it
receives the Royal Assent.
Principal Act
5 3. In this Act the Town Planning and Development Act 1928* is
referred to as the principal Act.

New section 54DD inserted
4. The principal Act is amended by inserting after section 54D
10 the following --
``
Written reasons for determination of appeals by
Minister and publication thereof
54DD. The Minister --
15 (a) shall give to the parties to an appeal to the
Minister written reasons for the determination of
the Minister on the appeal; and
(b) shall publish those reasons in the Gazette within
14 days of such determination taking effect; and
20 (c) shall, upon payment of a fee determined in the
manner prescribed, supply a copy of those
reasons to any other person.
''.
