A Bill for
An Act to amend the Retail Trading Hours Act 1987.
The Parliament of Western Australia enacts as follows:

1 1. Short title
2 This is the Retail Trading Hours Amendment Act 2009.
3 2. Commencement
4 This Act comes into operation as follows --
5 (a) sections 1 and 2 -- on the day on which this Act
6 receives the Royal Assent;
7 (b) the rest of the Act -- on a day fixed by proclamation.
8 3. Act amended
9 This Act amends the Retail Trading Hours Act 1987.
10 4. Section 12 amended
11 (1) In section 12(1):
12 (a) after "retail shop" (second occurrence) insert:

14 that is not in the metropolitan area
15
16 (b) after each of paragraphs (a) to (c) insert:

20 (2) In section 12(2):
21 (a) in paragraph (a) delete "special trading precinct or";
22 (b) delete paragraph (b) and "or" after it;

1 (3) After section 12(2) insert:

3 (3) Subject to this Act and any order made under
4 section 12E(1) that affects the trading hours of a
5 general retail shop, a general retail shop in the
6 metropolitan area shall be closed --
7 (a) on Monday, Tuesday, Wednesday, Thursday
8 and Friday in each week, until 8 a.m. and from
9 and after 9 p.m.; and
10 (b) on Saturday in each week, until 8 a.m. and from
11 and after 5 p.m.; and
12 (c) on Sunday in each week; and
13 (d) on each public holiday and public half-holiday.
14 (4) Subsection (3) does not apply to --
15 (a) a general retail shop in a special trading
16 precinct or holiday resort, as defined in
17 section 12A(4); or
18 (b) a general retail shop to which an order under
19 section 12A applies by the operation of
20 subsection (3) of that section; or
21 (c) a motor vehicle shop.

23 5. Section 12E amended
24 (1) In section 12E(1)(a) delete "section 12(1)," insert:

26 section 12(1) or (3),

28 (2) Delete section 12E(2) and insert:

30 (2) An order varying the trading hours of general retail
31 shops in the metropolitan area (other than an order

1 under section 12A) can have effect only in relation to a
2 day or days within the period of 28 days ending on
3 1 January.

5 6. Section 14A amended
6 In section 14A(1) delete "section 12(1)," and insert:

8 section 12(1) if the filling station is not in the
9 metropolitan area or section 12(3) if the filling station
10 is in the metropolitan area,

12 7. Section 14C amended
13 In section 14C(4)(a) delete "section 12(1);" and insert:
