A Bill for
An Act to amend the Real Estate and Business Agents Act 1978.
The Parliament of Western Australia enacts as follows:

1. Short title
This is the Real Estate and Business Agents Amendment
Act 2007.
2. Commencement
5 This Act comes into operation as follows:
(a) sections 1 and 2 -- on the day on which this Act
receives the Royal Assent;
(b) the rest of the Act -- on a day fixed by proclamation.
3. The Act amended
10 The amendments in this Act are to the Real Estate and Business
Agents Act 1978.
4. Section 4 amended
Section 4(1) is amended in the definition of "business agent" by
deleting the passage from and including "does not include" to
15 the end of the definition and inserting instead --
"
does not include --
(a) a person whose business is to so act by
reason that --
20 (i) the person is appointed by a court as a
receiver or receiver and manager of
the business of another; or
(ii) the person is an official receiver or
trustee within the meaning of the
25 Bankruptcy Act 1966 of the
Commonwealth or any Act in
amendment or substitution of that
Act;
or

(b) a person that is prescribed or that belongs to
a class of persons that is prescribed;
".
5. Section 145 amended
5 Before section 145(2)(a) the following paragraph is inserted --
"
(aa) prescribe a person or class of persons for the
purposes of the definition of "business agent"
in section 4(1);
10 ".
