An Act to amend the Perth Theatre Trust Act 1979.



The Parliament of Western Australia enacts as follows:

 1   1.         Short title
 2              This Act is the Perth Theatre Trust Amendment Act 2009.

 3   2.         Commencement
 4              This Act comes into operation as follows:
 5               (a) sections 1 and 2 - on the day on which this Act receives
 6                     the Royal Assent;
 7               (b) the rest of the Act - on a day fixed by proclamation.

 8   3.         Act amended
 9              This Act amends the Perth Theatre Trust Act 1979.

10   4.         Section 3 amended
11              In section 3(1) insert in alphabetical order:

13                performing arts material means, under section 16, any
14                   object having a connection with or containing
15                   information about the performing arts related to the
16                   history of the building under the auspices of the Perth
17                   Theatre Trust which could include costumes and
18                   accessories, musical instruments, personal effects,
19                   stage properties, puppets, set and costume designs, set
20                   models, technical equipment, film video, photographs,
21                   posters, programs, scrapbooks, sheet music and sound
22                   recordings;

24   5.         Section 16 amended
25        (1)   In section 16 after paragraph (f) insert:

27                     (fa)   to hold a Perth Theatre Trust Collection which
28                            comprises of:
29                              (i) all performing arts material;

 1   (ii)    performing arts material acquired and
 2           accepted by the trust; and
 3   (iii)   all donations, gifts, dispositions and
 4           trusts of property, real or personal, other
 5           than money, lawfully made or declared
 6           by deed, will or otherwise to or in
 7           favour of the Trust or the uses or
 8           purposes of the Trust and accepted for
 9           the collection by the Trust.
