Police Act Amendment (Prohibition of Street
Prostitution) Bill 1999
A Bill for
An Act to amend the Police Act 1892.
The Parliament of Western Australia enacts as follows:
1. Short title
This Act may be referred to as the Police Act Amendment
(Prohibition of Street Prostitution) Act 1999.
5 2. Commencement
This Act comes into operation on the day on which it receives
the Royal Assent.

3. Principal Act
In this Act the Police Act 1892* is referred to as the principal
Act.

4. New section 65A
The principal Act is amended by inserting after section 65 the
following --

65A. Soliciting
(1) A person shall not, for the purpose of offering or
procuring commercial sexual services, accost any
person, or solicit or loiter, in a street or thoroughfare.
15 Penalty: $ 2 000.
(2) A person shall not, for the purpose of offering or
procuring commercial sexual services, accost any child
in a street or thoroughfare.
Penalty: Imprisonment for 2 years.
20 (3) In this section --
"child" has the meaning given to it under section 1 of
The Criminal Code;
"commercial sexual services" means sexual services
provided for monetary or material reward
25 (irrespective of whether the reward is, or is to be,
paid or given to the prostitute or another person);
"prostitute" means a person who provides commercial
sexual services;

"sexual services" means --
(a) an act of carnal knowledge or carnal
connection as those terms are defined in
section 6 of The Criminal Code;
5 (b) the masturbation of one person by
another; or
(c) any activity which involves the use of
one person by another for his or her
sexual gratification;
10 "street" has the meaning given to it under section 2 of
this Act; and
"thoroughfare" has the meaning given to it under
section 2 of this Act.
