Liquor Licensing Amendment Bill 2004
A Bill for
An Act to amend the Liquor Licensing Act 1988.
The Parliament of Western Australia enacts as follows:
1. Short title
This Act may be cited as the Liquor Licensing Amendment Act
5 2004.

2. Commencement
This Act comes into operation on the day on which it receives the
Royal Assent.
3. Principal Act
5 The amendments in this Act are to the Liquor Licensing
Act 1988.
4. Section 97 amended
(1) Section 97(3) is amended by adding the following after
paragraph (d) --
10 "
(da) under a liquor store licence, between 10 am and
10 pm, except where Coles Myer Limited,
Woolworths Limited or any other prescribed
company listed on the Australian Stock
15 Exchange or any other recognised stock
exchange:
(i) is the holder, or part or joint holder, of
the licence;
(ii) holds 20% or more of the shares in the
20 holder, or part or joint holder, of the
licence;
(iii) is a related body corporate of or
associated with or is connected with (as
those terms are defined in the
25 Corporations Act 2002 (C'wealth)) the
holder, or part or joint holder, of the
licence; or
(iv) exercises control or direction over the
holder, or part or joint holder, of the
30 licence.
".

(2) Section 97(3)(f) is amended by adding after the word "licence"
where it first appears--
"
in which Coles Myer Limited, Woolworths Limited or
5 any other prescribed company listed on the Australian
Stock Exchange or any other recognised stock
exchange holds an interest as referred to in
subsection 3(da)
".
