Hospitals and Health Services Amendment
Bill 2002
A Bill for
An Act to amend the Hospitals and Health Services Act 1927 and for
related purposes.
The Parliament of Western Australia enacts as follows:
1. Short title
This Act may be cited as the Hospitals and Health Services
Amendment Act 2002.

2. Commencement
This Act comes into operation on the day on which it receives
the Royal Assent.
3. The Act amended
5 The amendments in this Act are to the Hospitals and Health
Services Act 1927*.

10 4. Section 7 amended
Section 7(2) is amended by deleting "powers and duties" and
inserting instead --
" duties, powers and functions ".
5. Section 7A amended
15 (1) Section 7A(1)(ba) is deleted and the following paragraphs are
inserted instead --
"
(ba) to provide pathology services and related medical
scientific services for the purpose of diagnosing
20 and managing disease or protecting public health;
(bb) to provide forensic biology services and
forensic pathology services, including obtaining
DNA profiles for forensic or other purposes;
(bc) to conduct training and instruction in, and
25 research into, the services referred to in
paragraphs (ba) and (bb);
".
(2) Section 7A(2) is amended by deleting "of the duties" and
inserting instead --
30 " or exercise of the duties, powers ".

6. Section 7B amended
Section 7B(1) is amended by deleting "carrying out any duty"
and inserting instead --
" the performance or exercise of any duty, power ".
5 7. Section 18 amended
Section 18(1)(b) is amended by deleting "such other duties" and
inserting instead --
" or exercise such other duties, powers ".
8. Validation
10 (1) In this section --
"agency" has the same meaning as it has in the Hospitals and
Health Services Act 1927.
(2) Anything done or purporting to have been done by an agency
for the purposes referred to in section 7B(1) of the Hospitals
15 and Health Services Act 1927 is, and is taken always to have
been, as valid and effective as it would have been if the
amendments to that Act in sections 5 and 6 had at all relevant
times been made.
