A Bill for
An Act to promote the use of solar and other efficient hot water
systems in Western Australia.
The Parliament of Western Australia enacts as follows:

Part 1 -- Preliminary
1. Short title
This is the Greenhouse Gas Emission Reduction (Hot Water
Systems) Act 2007.
5 2. Commencement
This Act comes into operation on Royal Assent.
3. Definitions
"compliant heat pump hot water system" means --
(a) a heat pump solar hot water system that complies
10 with such requirements as are prescribed; or
(b) if no requirements have been prescribed, a heat pump
solar hot water system, complying with Australian
Standard 2712-2002 that has been tested in
accordance with Australian Standard 4234-1994, and
15 achieves a minimum energy saving of 60 per cent for
a hot water demand level of 38MJ per day for climate
zone 3;
"compliant gas hot water system" means --
(a) a gas hot water system that complies with such
20 requirements as are prescribed; or
(b) if no requirements have been prescribed, a gas hot
water system, complying with Australian Standard
4552-2005, that achieves a minimum energy rating of
"5 stars";
25 "compliant solar hot water system" means --
(a) a solar hot water system that complies with such
requirements as are prescribed; or
(b) if no requirements have been prescribed, a solar hot
water system, complying with Australian Standard
30 2712-2002, that has been tested in accordance with

Australian Standard 4234-1994, and achieves
minimum energy saving of 60 per cent for a hot water
demand level of 38MJ per day for climate zone 3;
"hot water system" means a system that is to supply hot water
5 for amenity purposes including washing, bathing or
showering.
4. Objects of Act
The object of this Act is to reduce greenhouse gas emissions
associated with the use of hot water systems in Western
10 Australia.
5. Crown Bound
This Act binds the Crown in right of the State and, subject to the
limits of the legislative power of the State, the Crown in all its
other capacities.

6. Restriction on sale, hire etc of hot water systems
From 1 July 2009 a hot water system shall not be sold, hired or
5 exposed for sale or hire or advertised for sale or hire, unless it
is --
(a) a compliant solar hot water system;
(b) a compliant gas hot water system;
(c) a compliant heat pump hot water system; or
10 (d) such other hot water system as is prescribed.
Penalty: $20,000

Part 3 -- General
7. Regulations
(1) The Governor may make regulations prescribing all matters that
are required or permitted by this Act to be prescribed, or are
5 necessary or convenient to be prescribed, for the purposes of
this Act.
(2) Regulations made under subsection 6(1)(d) may not be made
unless the Minister is satisfied that the greenhouse gas
emissions associated with the hot water system are equivalent to
10 or less than the greenhouse gas emissions associated with the
operation of one or more of the other systems listed in
subsection 6(1).
(3) Regulations made under section 3 to establish alternative
requirements for the hot water system referred to in that section
15 shall not be made unless the Minister is satisfied that the
greenhouse gas emissions associated with the alternative
requirements are equal to or less than the greenhouse gas
emissions associated with the existing requirements.
