Energy Operators and Water Agencies (Powers)
Amendment Bill 2003
A Bill for
An Act to amend the Energy Operators (Powers) Act 1979 and the
Water Agencies (Powers) Act 1984.
The Parliament of Western Australia enacts as follows:
1. Short title
This Act may be cited as the Energy Operators and Water
5 Agencies (Powers) Amendment Act 2003.
2. Commencement
This Act comes into operation on the day on which it receives
the Royal Assent.

3. The Energy Operators (Powers) Act 1979 amended
(1) Section 45(2) of the Energy Operators (Powers) Act 1979 is
amended by deleting "No" and inserting instead --
" Subject to subsection (2a), no ".
5 (2) Section 45 of the Energy Operators (Powers) Act 1979 is
amended by inserting after subsection (2) the following --
"
(2a) Subsection (2) shall not affect the amount of any
compensation otherwise payable by the energy
10 operator in accordance with this section or Parts 9 and
10 of the Land Administration Act 1997.
".
4. The Water Agencies (Powers) Act 1984 amended
(1) Section 81(2) of the Water Agencies (Powers) Act 1984 is
15 amended by deleting "No" and inserting instead --
" Subject to subsection (2a), no ".
(2) Section 81 of the Water Agencies (Powers) Act 1984 is
amended by inserting after subsection (2) the following --
"
20 (2a) Subsection (2) shall not affect the amount of any
compensation otherwise payable by the Commission or
the Corporation in accordance with this section or Parts
9 and 10 of the Land Administration Act 1997.
".
