Criminal Injuries Compensation Amendment
Bill 2003
A Bill for
An Act to amend the Criminal Injuries Compensation Act 1985.
The Parliament of Western Australia enacts as follows:
1. Short title
This Act may be cited as the Criminal Injuries Compensation
5 Amendment Act 2003.
2. Commencement
This Act shall come into operation on the day on which it
receives the Royal Assent.

3. Principal Act
In this Act the Criminal Injuries Compensation Act 1985 is
referred to as the principal Act.
4. Section 20 amended
5 Section 20 of the principal Act is amended --
(a) in subsection (1) by deleting "$15 000, or such other"
and substituting the following --
" $75 000, or such greater ";
(b) by inserting at the end of subsection (2) the following --
10 "
unless the offences or alleged offences were
against two or more persons
"; and
(c) by inserting after subsection (3) the following --
15 "
(4) Notwithstanding any other provision of this
section, where an application is made under this
Act for compensation for injury or loss suffered
by 2 or more persons in consequence of the
20 commission of an offence or alleged offence or
2 or more offences or alleged offences against
those persons the Chief Assessor may, in
determining that application, award more than
the prescribed maximum amount referred to in
25 subsection (1) in the aggregate in respect of an
offence or alleged offence or all of the offences
or alleged offences.
(5) The provisions of subsection (4) shall apply to
any application determined after 1 July 2003
30 and the Chief Assessor shall, on the written
request of the applicant, make a fresh
determination in relation to any application

determined between 1 July 2003 and the
commencement of the Criminal Injuries
Compensation Amendment Act 2003.
