A Bill for
An Act to amend the Children and Community Services Act 2004.
The Parliament of Western Australia enacts as follows:

Part 1 -- Preliminary
1. Short title
This Act may be cited as the Children and Community Services
Amendment (Body Piercing) Act 2007.
5 2. Commencement
This Act comes into operation on the day on which it receives the
Royal Assent.

3. The Act amended
The amendment in this Part is to the Children and Community
5 Services Act 2004.
4. Sections 103A and 103B inserted
After section 103 the following sections are inserted --
"
103A. Body piercing
10 (1) Subject to section 103B, a person must not pierce any
part of the body of a child unless the person has first
obtained the written consent of a parent of the child to
pierce that part of the child's body.
Penalty: $12 000 and imprisonment for one year.
15 (2) This section does not apply in relation to a piercing
performed for a medical or therapeutic purpose.
103B. Particular body piercing of a child prohibited
(1) A person must not perform body piercing to any part
of --
20 (a) the external genitalia of a female who is a child;
or
(b) the penis or scrotal skin of a male who is a
child; or
(c) the nipples of a child.
25 Penalty: $12 000 and imprisonment for one year.

(2) It is not a defence to an offence under subsection (1)
that the child, or a parent of the child, consented to the
body piercing.
