A Bill for
An Act to amend the Anzac Day Act 1960 and a number of other
Acts, and for related purposes.
The Parliament of Western Australia enacts as follows:

Part 1 -- Preliminary
1. Short title
This is the ANZAC Day Amendment Act 2005.
2. Commencement
5 This Act comes into operation on the day on which it receives the
Royal Assent.

3. The Act amended
The amendments in this Part are to the Anzac Day Act 1960*.

4. Section 3A inserted and consequential amendment
(1) After section 3 the following section is inserted --
"
10 3A. Confirmation of the status of ANZAC Day and
recognition of sacrifices made
(1) In this Act and in any other written law --
"ANZAC Day" means 25 April in each year.
(2) This Act confirms the status of ANZAC Day as a day
15 for the commemoration of the landing of Australian
and New Zealand troops on the shores of Gallipoli on
25 April 1915 and recognises the sacrifices made by all
Australian men and women serving their country in
times of war and conflict and in peacekeeping duties.
20 ".
(2) Section 3 is amended by deleting the definition of "Anzac Day".
5. Section 5 amended
Section 5(4) is repealed.
6. Section 7 amended
25 Section 7(3) is repealed.

7. Various references to "Anzac" amended and saving
(1) The long title is amended by deleting "Anzac" in both places
where it occurs and inserting instead --
" ANZAC ".
5 (2) Section 1 is amended by deleting "Anzac" and inserting
instead --
" ANZAC ".
(3) Section 3 is amended in the definition of "Trust" by deleting
"Anzac" and inserting instead --
10 " ANZAC ".
(4) Sections 4(1), (2) and (4), 5(1) and (2), 6(1), (2) and (4) and
7(1) and (2) are amended by deleting "Anzac" and inserting
instead --
" ANZAC ".
15 (5) Sections 10(1) and 11(1) are amended by deleting "Anzac" and
inserting instead --
" ANZAC ".
(6) The amendments made by subsection (5) do not affect the
continuity of the Anzac Day Trust Fund and The Anzac Day
20 Trust established and constituted under sections 10 and 11 of
the Anzac Day Act 1960 before the coming into operation of this
Act.
8. Various references to "Treasurer" amended and saving
(1) Section 10(1) and (3) are amended by deleting "Treasurer" in
25 each place where it occurs and inserting instead --
" Minister ".

(2) Section 11(3)(b), (c) and (d), (4)(a), (b) and (c) and (5)(a), (b)
and (c) are amended by deleting "Treasurer" in each place
where it occurs and inserting instead --
" Minister ".
5 (3) The amendments made by subsection (2) do not affect the
offices of the Trustees of The Anzac Day Trust holding office
under section 11(3)(b), (c) and (d) of the Anzac Day Act 1960
when this Act comes into operation.

9. Financial Administration and Audit Act 1985 amended
(1) The amendments in this section are to the Financial
Administration and Audit Act 1985*.

10 (2) Schedule 1 is amended by deleting "The Anzac" and inserting
instead --

10. Gaming and Wagering Commission Act 1987 amended
(1) The amendments in this section are to the Gaming and
15 Wagering Commission Act 1987*.

(2) Section 46(4) is amended by deleting "Anzac" and inserting
20 instead --
" ANZAC ".
11. Liquor Licensing Act 1988 amended
(1) The amendments in this section are to the Liquor Licensing
Act 1988*.

(2) Section 49(5)(a) is amended by deleting "Anzac" and inserting
instead --
" ANZAC ".
(3) Section 97(2), (3), (6), (6)(b)(i) and (ii) and (6)(c)(i) and (ii) are
5 amended by deleting "Anzac" and inserting instead --
" ANZAC ".
(4) Schedule 2 Division 1 is amended as follows:
(a) in the Division heading and the heading to clause 2 by
deleting "Anzac" and inserting instead --
10 " ANZAC ";
(b) in the definitions of "the club" and "the State Branch
Headquarters" in clause 1 by deleting "Anzac" and
inserting instead --
" ANZAC ".
15 12. Minimum Conditions of Employment Act 1993 amended
(1) The amendments in this section are to the Minimum Conditions
of Employment Act 1993*.
