An Act to amend various Acts to reflect changes made to the
Bankruptcy Act 1966 (Commonwealth) and for related purposes.
The Parliament of Western Australia enacts as follows:

2 1. Short title
3 This is the Acts Amendment (Bankruptcy) Act 2009.
4 2. Commencement
5 This Act comes into operation as follows --
6 (a) Part 1 -- on the day on which this Act receives the
7 Royal Assent;
8 (b) the rest of the Act -- on the day after that day.

3 This Part amends the Interpretation Act 1984.

5 In section 5 insert in alphabetical order:

7 bankrupt and bankrupt or a person whose affairs are
8 under insolvency laws have the meanings given in
9 section 13D;

12 After section 13C insert:

14 13D. Meaning of "bankrupt" and related expression
15 (1) A reference in a written law to a person being a
16 bankrupt means that the person is a bankrupt as defined
17 in the Bankruptcy Act 1966 (Commonwealth) or has a
18 substantially similar status under a law applicable in a
19 place where that Act does not apply.
20 (2) A reference in a written law to a person being a
21 bankrupt or a person whose affairs are under
22 insolvency laws means that --
23 (a) the person is a bankrupt as described in
24 subsection (1); or
25 (b) the person is a party, as a debtor, to a debt
26 agreement under the Bankruptcy Act 1966
27 (Commonwealth); or
28 (c) the person has, as a debtor, entered into a
29 personal insolvency agreement under Part X of
30 the Bankruptcy Act 1966 (Commonwealth) and

1 obligations created by the agreement remain to
2 be discharged; or
3 (d) the person has not yet entered a personal
4 insolvency agreement under Part X of the
5 Bankruptcy Act 1966 (Commonwealth) but has
6 authorised a controlling trustee to perform
7 functions under that Part,
8 or that the person has a substantially similar status
9 under a law applicable in a place where the Bankruptcy
10 Act 1966 (Commonwealth) does not apply.
