VICTORIAN WORKERS' WAGES PROTECTION ACT 2007 (NO. 71 OF 2007) - SECT 23

Reverse onus if employee deceased

    (1)     If a proceeding is brought under section 12 in respect of a contravention of section 6 and the employee is dead at the time the proceeding is heard, in the absence of evidence to the contrary, the employer must be taken to have not paid all of the employee's wages in money.

    (2)     If a proceeding is brought under section 12 in respect of a contravention of section 7 or 10 and the employee is dead at the time the proceeding is heard, in the absence of evidence to the contrary, the deduction must be taken to be an unlawful deduction.
