ROAD MANAGEMENT ACT 2004 (NO 12 OF 2004) - SECT 174
Rail Corporations Act 1996(1) In section 62(1) of the Rail Corporations Act 1996 for "After consultation with the Roads Corporation and any relevant municipal council" substitute "Subject to the Road Management Act 2004 ".
(2) After section 62(2) of the Rail Corporations Act 1996 insert —
"(2A) A direction given by the Director under this section must not be inconsistent with the Road Management Act 2004 .
(2B) A direction has no effect to the extent of any inconsistency under sub-section (2A).".
(3) In section 63(1) of the Rail Corporations Act 1996 for "After consultation with the Roads Corporation and any relevant municipal council" substitute "Subject to the Road Management Act 2004 ".
(4) After section 63(2) of the Rail Corporations Act 1996 insert —
"(2A) A direction given by the Director under this section must not be inconsistent with the Road Management Act 2004 .
(2B) A direction has no effect to the extent of any inconsistency under sub-section (2A).".
(5) In section 66(1) of the Rail Corporations Act 1996 —
(a) for "A" substitute "Subject to the Road Management Act 2004 , a";
(b) omit ", after consultation with the Roads Corporation or any relevant municipal council,".
(6) After section 66(2) of the Rail Corporations Act 1996 insert —
"(2A) A direction given by the Director under this section must not be inconsistent with the Road Management Act 2004 .
(2B) A direction has no effect to the extent of any inconsistency under sub-section (2A).".
(7) In section 67(1) of the Rail Corporations Act 1996 —
(a) for "A" substitute "Subject to the Road Management Act 2004 , a";
(b) in paragraph (a) omit "after consultation with the Roads Corporation and any relevant municipal council,".
(8) After section 67(2) of the Rail Corporations Act 1996 insert —
"(2A) A direction given by the Director under this section must not be inconsistent with the Road Management Act 2004 .
(2B) A direction has no effect to the extent of any inconsistency under sub-section (2A).".
