MARINE SAFETY ACT 2010 (NO. 65 OF 2010) - SECT 73
Offence to allow operation of a commercial vessel by persons in breach of crewing and certification requirements(1) A person must not employ or engage another person to act as a master of or a crew member on a commercial vessel in any capacity for which a certificate of competency is required under the regulations unless that other person holds an appropriate certificate of competency.
Penalty: 60 penalty units.
(2) The owner of a commercial vessel must not cause or allow the vessel to be operated on State waters unless it is crewed in accordance with the regulations.
Penalty: 60 penalty units.
