MARINE SAFETY ACT 2010 (NO. 65 OF 2010) - SECT 63
Offence to breach conditions of safe construction certificate(1) The owner of a commercially operated vessel must not operate the vessel, or cause or allow the vessel to be operated, in breach of any condition of the safe construction certificate issued in respect of the vessel.
Penalty: 60 penalty units.
(2) The master of a commercial vessel must not operate the vessel, or cause or allow the vessel to be operated, in breach of any condition of the safe construction certificate issued in respect of the vessel.
Penalty: 60 penalty units.
(3) It is a defence to a prosecution for an offence against subsection (2) if the master was acting under the instruction of the owner of the vessel.
