MARINE SAFETY ACT 2010 (NO. 65 OF 2010) - SECT 397

    (1)     In section 228S(1) of the Transport (Compliance and Miscellaneous) Act 1983 insert the following definitions—

""commercial marine duty holder" means a person to whom sections 24 to 30 of the Marine Safety Act 2010 apply;

"marine premises" means—

        (a)     the building or facilities used in connection with the undertaking of marine operations; and

        (b)     land on which vessels are stored but does not include land used for residential purposes;".

    (2)     In section 228S(1) of the Transport (Compliance and Miscellaneous) Act 1983 , in the definition of "relevant person" , before paragraph (e) insert —

    "(db)     a commercial marine duty holder; or".

    (3)     In section 228S(1) of the Transport (Compliance and Miscellaneous) Act 1983 , in paragraph (c) of the definition of compliance and investigative purposes , after "matter" insert "or a marine safety matter".
