MARINE SAFETY ACT 2010 (NO. 65 OF 2010) - SECT 379
Offences involving alcohol or other drugs(1) In section 28(1) of the Marine Act 1988 —
(a) in paragraphs (a) and (b), for "is in charge of a vessel under way" substitute "operates a vessel under way";
(b) in paragraph (e) , for "in charge of" (where first occurring) substitute "involved in the operation of";
(c) in paragraph (e)(ii), for "after being in charge of" substitute "after operating";
(d) in paragraph (f), for "in charge of" (wherever occurring) substitute "involved in the operation of".
(2) In sections 28(2) and 28(3) of the Marine Act 1988 omit ", other than an accompanying operator offence,".
(3) Section 28(3A), (6) and (7) of the Marine Act 1988 are repealed .
