MARINE SAFETY ACT 2010 (NO. 65 OF 2010) - SECT 295

Evidence

    (1)     The production of a document purporting to be a copy of, or an extract from, the Commonwealth of Australia Gazette containing the Uniform Shipping Laws Code or any part of it is evidence—

        (a)     that the document is a copy of that Code or that part; and

        (b)     that the Code has been adopted by the body of Commonwealth, State and Territory Ministers known as the Australian Transport Council—

and, in the absence of evidence to the contrary, is proof of those facts.

    (2)     The certificate in writing of a surveyor or inspector that a vessel does (or does not) comply with a provision of the Uniform Shipping Laws Code is evidence of the fact that the vessel does (or does not) comply with that provision and, in the absence of evidence to the contrary, is proof of that fact.
