MARINE SAFETY ACT 2010 (NO. 65 OF 2010) - SECT 160

Arrest without warrant

    (1)     A member of the police force may arrest without warrant any person who—

        (a)     within sight of the member of the police force, commits an offence against this Act or the regulations; and

        (b)     on being requested to give his or her name and address—

              (i)     refuses or fails to give his or name and address; or

              (ii)     gives a name or address that the member of the police force reasonably suspects to be false.

    (2)     If a person who is arrested for an offence under this Act or the regulations was in charge of a vessel, any member of the police force may take charge of the vessel and may move it to an appropriate place and keep or leave it there—

        (a)     pending the admission of the arrested person to bail; or

        (b)     if the arrested person is not the owner of the vessel, pending a demand for the vessel by its owner.
