HERITAGE ACT 2017 (NO. 7 OF 2017) - SECT 38
Executive Director recommendations for exempted works or activities(1) If the Executive Director makes a recommendation to the Heritage Council that a place or object should be included in the Heritage Register, the Executive Director may include in the recommendation categories of works or activities which may be carried out in relation to the place or object without the need for a permit under Part 5.
(2) The Executive Director must not make a recommendation referred to in subsection (1) in relation to any categories of works or activities if the Executive Director considers that the works or activities may harm the cultural heritage significance of the place or object.
(3) The Executive Director may consult with the owner of the place or object before making the recommendation.
