9. Person not to damage, disturb or destroy any wildlife habitat



(1) A person must not wilfully damage, disturb or destroy any wildlife
habitat.

(2) Subregulation (1) does not apply to a person who is-

   (a)  authorised to do so under the Act; or

   (b)  the holder of a licence granted under the Forests Act 1958 to harvest
        timber or other forest produce; or



   (ba) undertaking timber harvesting operations that are authorised
        operations referred to in section 45(2)(a) and (b)(i) of the
        Sustainable Forests (Timber) Act 2004; or

   (c)  authorised to do so under any other Act.

Penalty: 50 penalty units.
