Devices and signs for school buses

31. Devices and signs for school buses



(1) This regulation applies to a person who is-

   (a)  the holder of a licence of an omnibus;

   (b)  the driver of an omnibus;

   (c)  an accredited person operating a vehicle-

used to carry school children and teachers and supervisors and no other adult
passengers.

(2) Subregulations (4)(a)(ii), (4)(b) and (5)(b) do not apply to a person if
the person is also the registered operator (within the meaning of the
Road Safety Act 1986) in relation to that vehicle.

(3) If the vehicle is not fitted with alternately flashing warning lights
under Division 18 of Schedule 8 to the Road Safety (Vehicles) Regulations
1999, a person must ensure that the vehicle has-

   (a)  a hazard warning device; and

(b) signs fitted to the front and rear of the omnibus displaying the words
"SCHOOL BUS" in capital letters at least 100 millimetres high.

Penalty: 10 penalty units.

(4) If the vehicle is fitted with alternately flashing warning lights under
Division 18 of Schedule 8 to the Road Safety (Vehicles) Regulations 1999, a
person must ensure that the vehicle has-





   (a)  a sign fitted to the front of the vehicle that-

(i) displays the words "SCHOOL BUS" in capital letters at least 100
millimetres high; or

   (ii) displays an image of two children in accordance with the requirements
        specified in clauses 117(1)(b) and (3) of Schedule 8 to the Road
        Safety (Vehicles) Regulations 1999; and

   (b)  a sign fitted to the rear of the vehicle displaying an image of two
        children in accordance with the requirements specified in clauses
        117(2) and (3) of Schedule 8 to the Road Safety (Vehicles) Regulations
        1999.

Penalty: 10 penalty units.

(5) The licence holder, accredited person or driver of a vehicle that is
required to have a hazard warning device under subregulation (3)(a) or
alternating flashing warning lights under subregulation (4) must ensure that
the device operates-

   (a)  when the vehicle is stationary on a highway for the purpose of picking
        up or setting down school children; and

   (b)  at all times in accordance with clause 116 of Schedule 8 to the Road
        Safety (Vehicles) Regulations 1999.

Penalty: 10 penalty units.
