2.12. Reference on petition of mercy



(1) If the Attorney-General refers a case to the Court of Appeal under section
584(a) of the Act, the petitioner whose case is referred shall for the
purposes of the Act and this Order be taken to be a person who has obtained
leave to appeal from the Court of Appeal.

(2) Unless otherwise directed by the Court of Appeal, the petition shall stand
in place of a notice of appeal and Rules 2.09 and 2.09.1 shall apply only to
the extent, and in the manner, directed by the Court of Appeal.

(3) If the Attorney-General refers a point under section 584(b) of the Act,
the point may be considered in private.
