Effect of non-compliance

2.02. Effect of non-compliance

Except as provided by this Order, a failure to comply with this Order or with
any rule of practice in force under the Act shall not prevent the prosecution
of an appeal or application for leave to appeal if the Court considers that,
in the interests of justice, the failure should be waived or remedied and the
matter proceed.
