Motor car death or bodily injury
6.05. Motor car death or bodily injury
(1) In any proceeding in which the plaintiff claims damages in respect of
death or bodily injury caused by or arising out of the use of a motor car,
originating process shall not be taken to have been served on the defendant
unless a copy of the originating process is served on the defendant in
accordance with these Rules and also on the Transport Accident Commission.
(2) Where in a proceeding to which paragraph (1) applies a copy of the
originating process has been duly served on the defendant but not on the
Transport Accident Commission, the Court, notwithstanding paragraph (1), may
order that the originating process be taken to have been served on the
defendant.
