Summons for directions

2.04. Summons for directions



(1) When originating process marked in accordance with Rule 2.03(1) is filed,
the plaintiff shall apply for directions.

(2) The application for directions shall be by summons and shall-

   (a)  be addressed to the defendant or the defendants; and

   (b)  be served with the originating process.

(3) Upon the hearing or further hearing of a summons for directions or when
hearing an application under Rule 2.03(2) the Judge in charge may give any
directions for the conduct of the proceeding which the Judge thinks conducive
to its effective, complete, prompt and economical determination.

(4) A summons for directions may be brought on for further hearing from time
to time by any party on giving reasonable notice to any other party and to the
Court.

(5) Nothing in this Order shall prevent a party from applying under Order 21
or 22 of Chapter I.

(6) If originating process marked in accordance with Rule 2.03(1) is served
out of Australia in accordance with Part I of Order 7 of Chapter I, a summons
for the purpose only of paragraph (2) may without order of the Court be served
with it.
