Application for internal review

402. Application for internal review



(1) The holder of a driver licence or learner permit or an applicant for a
driver licence or learner permit affected by a decision of the Corporation to-

   (a)  refuse an application for a driver licence or a learner permit or an
        application for a variation or renewal of a driver licence; or

   (b)  suspend, cancel or vary in any way a driver licence or learner permit
        in accordance with section 24-

may, within 28 days after the day he or she is notified of the decision, apply
to the Corporation for an internal review of that decision.

(2) A decision cannot be reviewed by the person who made the decision.

(3) After considering an application for review, the Corporation must-

   (a)  affirm the decision; or

   (b)  vary the decision; or

   (c)  revoke the decision.

(4) The Corporation must notify the affected person in writing of its decision
under subregulation (1) within 28 days after the day on which the request for
internal review is received by the Corporation.

(5) A decision subject to internal review under this regulation is taken to be
affirmed by the Corporation if the Corporation does not give written notice of
its decision under subregulation (4) to the affected person within 28 days.

(6) The making of an application for internal review of a decision does not
stay the operation of the decision.
