Application of Part

3.5.1. Application of Part



(1) This Part applies only to the following types of plant-

   (a)  subject to subregulation (3), plant that processes material by way of
        a mechanical action that-

   (i)  cuts, drills, punches or grinds the material; or

   (ii) presses, forms, hammers, joins or moulds the material; or

   (iii) combines, mixes, sorts, packages, assembles, knits or weaves the
        material- including plant where the functions set out in subparagraphs
        (i), (ii) and (iii) are incidental to the main purpose of the plant;

   (b)  subject to subregulation (3), plant that lifts or moves people or
        materials (other than a ship, boat, aircraft or, except as provided in
        subregulation (4), a vehicle designed to be used primarily as a means
        of transport on a public road or rail);

   (c)  pressure equipment;

   (d)  tractors;

   (e)  earthmoving machinery;

   (f)  lasers;

   (g)  scaffolds;



   (h)  temporary access equipment;

        (i)    explosive-powered tools;

   (j)  turbines;

   (k)  amusement structures.

(2) Unless specified otherwise, this Part applies to all plant irrespective of
the date on which the plant was manufactured.

(3) Subregulations (1)(a) and (1)(b) do not include-

   (a)  plant that relies exclusively on manual power for its operation; and

   (b)  plant that is designed to be primarily supported by hand.

(4) Division 5 applies to a vehicle designed to be used primarily as a means
of transport on public roads or rail, if that vehicle is being used in a
workplace other than a public road or rail.
