3.4.3. Manufacturers

A manufacturer of plant that includes, or is intended to include, a confined
space must ensure that the plant is manufactured so that-

   (a)  the need for any person to enter the space is eliminated so far as is
        reasonably practicable; or

   (b)  if it is not reasonably practicable to eliminate the need to enter the
        space-

   (i)  the need to enter is reduced so far as is reasonably practicable; and

   (ii) any risk associated with the means of entry to and exit from the space
        is eliminated so far as is reasonably practicable or, if it is not
        reasonably practicable to eliminate the risk, reduced so far as is
        reasonably practicable. Note Act compliance-section 29 (see regulation
