Objectives


	1.	Objectives

     The objectives of these Regulations are to-

			(a)	prescribe fees payable by a party requiring a civil case to be tried by a jury in a civil case in the Supreme Court and the County Court; and

			(b)	to prescribe the rate of remuneration and allowances payable to jurors and persons who attend for jury service.

     These Regulations are made under section 90 of the Juries Act 2000.

Commencement


	3.	Commencement

     These Regulations come into operation on 1 August 2001.

Fees for civil juries


	4.	Fees for civil juries

     For the purposes of section 24(1) and (2) of the Juries Act 2000, the prescribed fees are as follows-

			(a)	on setting a proceeding down for trial by a jury in the Supreme Court or the County Court-46×9 fee units; and


			(b)	for each day after the first day of a trial not exceeding 6 days-5×7 fee units for each member of the jury; and



			(c)	for each day of a trial in excess of 6 days-11×3 fee units for each member of the jury.

	5.	Administrative expenses in respect of refund of fees

     For the purposes of section 24(7) of the Juries Act 2000, the prescribed fee is 4×6 fee units.

Rate of remuneration and allowances for jury service


	6.	Rate of remuneration and allowances for jury service

     
		(1)	For the purposes of section 51 of the Juries Act 2000 the prescribed rate of remuneration and allowances are as follows-

			(a)	for each day of attendance at court (whether the juror has actually served or not) not exceeding 6 days-$36.00; and

			(b)	for each day of attendance at court (whether the juror has actually served or not) in excess of 6 days but not exceeding 12 months-$72.00; and

			(c)	for each day of attendance at court (whether the juror has actually served or not) in excess of 12 months-$144.00.



		(2)	If a juror on the last day of a trial is required to serve for more than 8 hours (excluding the period of any adjournments for meals) the juror must be paid twice the amount prescribed for the day.

		(3)	A juror who resides outside the jury district for Melbourne is eligible for an allowance for travelling to court from his or her residence by the shortest practical route calculated at a rate of 38 cents per kilometre travelled in excess of 8 kilometres.

		(4)	An allowance under subregulation (3) is payable in respect of only one journey either to or from court each day.

1. General Information
The Juries (Fees, Remuneration and Allowances) Regulations 2001, S.R. No. 74/2001 were made on 31 July 2001 by the Governor in Council under section 90 of the Juries Act 2000, No. 53/2000 and came into operation on 1 August 2001: regulation 3.
The Juries (Fees, Remuneration and Allowances) Regulations 2001 will sunset 10 years after the day of making on 31 July 2011 (see section 5 of the Subordinate Legislation Act 1994).
