Use of gametes produced by children

11. Use of gametes produced by children

For the purposes of section 41 of the Act, a gamete, or a zygote or an embryo
formed from gametes, produced by a person less than 18 years old may be used
in a treatment procedure in accordance with the Act-

   (a)  if the gamete was collected from the person for use in later life by
        that person or, in the case of sperm, the wife of that person; and

   (b)  if the gamete was collected from the person for use in later life due
        to the likelihood of that person becoming infertile as a consequence
        of-

   (i)  a treatment to be undergone by that person; or

   (ii) an illness likely to be suffered by that person in later life.
