61. Therapeutic need to be determined-pharmacists

A pharmacist who supplies a Schedule 3 poison other than-

   (a)  by wholesale; or

   (b)  on the prescription of a registered medical practitioner, nurse
        practitioner, dentist, an authorised optometrist, an authorised
        podiatrist or veterinary practitioner-

must do so only for the therapeutic use of a person or animal, after having
taken all reasonable steps to ensure a therapeutic need exists for that
poison. Penalty: 50 penalty units.
