31. Circumstances where prescriptions are not to be filled



(1) A pharmacist must not supply a Schedule 4 poison, Schedule 8 poison or
Schedule 9 poison on a prescription-

   (a)  in excess of the quantities authorised; or

   (b)  which he or she has reason to believe has been forged or is fraudulent
        in any way; or

   (c)  which he or she has reason to believe has been altered in any way
        other than by or on the instruction of the prescriber; or

   (d)  which is illegible or defaced; or

   (e)  when the quantity authorised has already been supplied.

Penalty: 100 penalty units.

(2) A pharmacist to whom a prescription referred to in subregulation (1)(b) or
(c) is presented must without delay notify a member of the Victoria Police and
the Secretary of the circumstances concerning the presentation of the
prescription.

Penalty: 50 penalty units.
