Power of Authority to amend, suspend or revoke exemptions
503. Power of Authority to amend, suspend or revoke exemptions
(1) The Authority may at any time amend, suspend or revoke an exemption
granted under regulation 501 or 502, either at the request of the holder of
the exemption or on its own initiative.
(2) The Authority must not amend, suspend or revoke an exemption granted under
regulation 501 on its own initiative unless it has-
(a) notified the holder of the exemption that the Authority is proposing
to amend, suspend or revoke (as the case may be) the exemption; and
(b) provided the holder of the exemption with written reasons for the
proposed course of action; and
(c) invited the holder of the exemption to make a submission within a
specified time on the proposed course of action including a submission
on the appropriate amendment (if any) to be made; and
(d) considered any submissions that are made in response to the invitation
within the specified time.
(3) If the Authority decides to suspend an exemption granted under regulation
502 it must publish a notice in the Government Gazette and on the Internet on
a website maintained by the Authority that sets out-
(a) the date and time from which the suspension takes effect; and
(b) the date and time at which the suspension ceases to operate.
(4) If the Authority decides to revoke an exemption granted under regulation
502 it must publish a notice in the Government Gazette and on the Internet on
a website maintained by the Authority that sets out the date and time from
which the revocation takes effect.
